General information

  • An uncontested divorce requires the marriage to have lasted at least one year, both spouses to be heard in person by the judge, and the judge to approve their agreement on the financial consequences and the children.
  • Divorce cases are heard by the family court at the domicile of either spouse, or where the spouses lived together for the last six months before the case.
  • For property acquired after 1 January 2002, the statutory regime is, as a rule, participation in acquired property.
  • Where there is violence or a risk of violence, a protection order can be requested from the family court, the public prosecutor or the police.

How long does an uncontested divorce take?

It depends on the court’s workload. With a complete protocol the case is usually decided at a single hearing; the decision then becomes final once the appeal periods have passed.

Can I divorce in Türkiye if I live abroad?

Depending on the circumstances, a divorce case can be conducted through a lawyer holding a power of attorney. The details of jurisdiction and recognition should be assessed case by case.

How is custody decided?

The court decides according to the best interests of the child. Where needed, a social investigation report is obtained and a child of sufficient maturity is heard.
